The undersigned (hereinafter, "the Player") hereby warrants to the Tucson Men's
Senior Baseball League (hereinafter, "MSBL") that he meets the minimum age
requirement for the league, is in good physical condition, and that he has no
impairment or ailment preventing him from engaging in active or passive exercise
that will be harmful to his health, safety, comfort, or physical condition.
In consideration of being permitted to participate in MSBL, in any manner,
including but not limited to playing, practice, coaching, spectating or being
on the field or spectator area for any purpose whatsoever, including but not
limited to participating in any local, regional or national tournaments of the
MSBL, and fully understanding that participation in the game of baseball
includes the risk of serious personal injury, the Player does fully and
absolutely assume the risk of injury of any magnitude including fatality, and
does hereby forever absolutely release and hold harmless MSBL, their respective
directors, officers, employees, agents, servants, public officials, volunteers,
game officials and sponsors from all claims for damage whatsoever of any kind
now or in the future.
The Player shall participate in the programs of MSBL and/or use any of the
facilities, services or equipment of MSBL at his own risk. The Player waives any
and all claims, of whatsoever kind of nature, that may arise against the MSBL
as a result of the Player's participation in the MSBL's recreational baseball
program. The Player also acknowledges recognition of the MSBL rules and any
deviation of "helmet" or other equipment requirements is at his own risk.
The MSBL will provide limited medical insurance for the baseball schedule. The
MSBL will NOT give any refunds to players or teams for games not played for any
reason, including but not limited to injury, voluntary non-participation, or
weather related schedule cancellations.
I have read this release and understand that it is an absolute release and I
freely and voluntarily accept its terms. By this execution I, the Player, also
state that I have received a copy of the MSBL Rules and Regulations, and have
read, understand and agree to abide by them.
